When coverage is required in Oklahoma

Every employer and every employee is subject to the Administrative Workers' Compensation Act unless specifically exempted — there is no minimum employee-count threshold (85A O.S. §3). A defined list of relationships is excluded from the 'employee' definition entirely, including: agricultural/ranching/horticultural work where the employer's prior-year gross payroll for such workers was under $100,000 (or the worker is not operating motorized machinery); licensed real estate sales associates/brokers paid on commission; casual employment not in the course of the employer's trade; employers with five or fewer employees who are all closely related to the employer (within the second degree by blood/marriage) or household dependents; and youth sports leagues exempt from federal income tax (85A O.S. §2(18)(b)).

Who can be excluded in Oklahoma

Sole proprietors

Automatically excluded from the statutory definition of 'employee' — not required to carry coverage on themselves. No state filing is needed for this exclusion; a sole proprietor may instead elect to be covered by purchasing a policy of insurance that includes them (85A O.S. §2(18)(b)(7)).

Partners

Same treatment as sole proprietors: automatically excluded from 'employee' status; may elect coverage via an insurance policy (85A O.S. §2(18)(b)(7)).

LLC members

Members of an LLC who own at least 10% of the LLC's capital are excluded from 'employee' status; may elect coverage via a policy that includes them. The statute text found does not address members owning under 10% — treat that as unverified/likely still subject.

Corporate officers

Stockholder-employees who own 10% or more of the corporation's stock are excluded from 'employee' status and may elect coverage by policy. No cap on the number of officers who can be excluded was found in this provision — exclusion turns on individual ownership percentage, not a headcount cap (85A O.S. §2(18)(b)(7)).

Construction rules in Oklahoma

No construction-specific carve-out was found in the ownership-based exclusion at §2(18)(b)(7). Separately, 85A O.S. §36 creates prime-contractor/subcontractor liability rules commonly invoked in construction: if a subcontractor has an unexpired 'Affidavit of Exempt Status' on file with the Commission, the subcontractor (and anyone working with them who isn't the subcontractor's own employee) is conclusively presumed not to be an employee of the prime contractor. This is a liability-shielding mechanism, not the same thing as the ownership-based owner exclusion above.

How the exemption is filed

Two distinct mechanisms exist. (1) Ownership-based exclusion (sole proprietors, partners, LLC members ≥10%, stockholders ≥10%): automatic — no state filing required; election INTO coverage happens through the employer's insurance policy, not a Commission filing. (2) Affidavit of Exempt Status (85A O.S. §36; OAC 810:25-5-1): any individual or business entity not required to secure compensation may file this Commission-prescribed form with the Oklahoma Workers' Compensation Commission — nonrefundable fee up to $50 per filer, expires at midnight two years from filing date (renewable), filed electronically at ok.gov/wcc or by mailing an original plus one copy to the Commission at 1915 North Stiles Avenue, Oklahoma City, OK 73105. This affidavit is primarily used in contractor/subcontractor liability contexts (e.g., construction). Separately, the state's Office of Management and Enterprise Services (OMES) uses its own project-specific exemption affidavit (CAP Form D312, citing 85A O.S. §2(18)(b)(4)) for state government construction contracts — this OMES form applies only to natural-person sole proprietors, not entities, and is distinct from the general Commission affidavit.

Notes and open questions
