When coverage is required in Nevada
Nevada requires employers to secure workers' compensation coverage for their employees; there is effectively no minimum-employee-count exemption for a true employer with employees (Nevada Industrial Insurance Act, NRS Chapters 616A–616D). The notable carve-outs are for the business owner's own coverage (sole proprietor, partner, LLC member) and for corporate officers/LLC managers, both described below.
Who can be excluded in Nevada
Sole proprietors
A sole proprietor with NO employees is not required to maintain workers' compensation coverage on themselves, and may elect to secure coverage voluntarily. If the sole proprietor has any employees, coverage is mandatory for those employees. IMPORTANT EXCEPTION: a sole proprietor who is a contractor as defined in NRS 624.020 and who is operating within the scope of a Nevada contractor's license MUST secure workers' comp coverage even with no employees — the licensed-contractor exception overrides the general sole-proprietor exclusion.
Partners
NRS 616A.310 defines 'sole proprietor' to include working partners and members of working associations, so partners are generally treated the same as sole proprietors: not required to self-cover unless they are a licensed contractor under NRS 624 operating within scope of license, in which case coverage is required.
LLC members
Nevada's statutory scheme (NRS 616B.624) governs officers of quasi-public/private/nonprofit corporations AND managers of limited-liability companies together — LLC members/managers are, per multiple secondary sources describing this statute, automatically included in coverage requirements unless they file a rejection with the company and the insurer (see corporateOfficers below; the same mechanism applies to LLC managers).
Corporate officers
Officers or managers of a quasi-public or private corporation (and LLC managers) are automatically included in workers' compensation coverage requirements by default. They may REJECT coverage for themselves under NRS 616B.624 by filing a written rejection with the company and its insurer; the rejection can later be rescinded in writing. Multiple secondary sources (insurance-industry pages, not an .nv.gov page I could render as text) identify the specific form used for this rejection as Nevada Division of Industrial Relations Form D-43 ('Employee Election to Reject Coverage and Election to Waive the Rejection of Coverage for Excluded Persons'). Construction rules in Nevada
Contractors licensed under NRS 624 (the State Contractors' Board licensing chapter) operating within the scope of their license must secure workers' compensation coverage even as a sole proprietor with no employees — this is the main construction-relevant special rule identified (see soleProprietor above). No additional construction-only provisions beyond this licensed-contractor rule were confirmed.
How the exemption is filed
