When coverage is required in Kentucky
Kentucky has no small-employer size exemption: per the Education and Labor Cabinet's own compliance guidance, employers with one or more workers are required to maintain coverage, with no exception for family, temporary, or part-time employees (agriculture is excluded from the general employer definition under KRS 342.630, per secondary confirmation, but this was not independently verified in depth here).
Who can be excluded in Kentucky
Sole proprietors
A sole proprietor is excluded (not an 'employee') by default, but may elect to be included/covered under KRS 342.012.
Partners
Partners are excluded by default. A partnership composed entirely of 'qualified' partners (per KRS 342.012 — meaning the partnership agreement shows the partner made a contribution enabling substantial participation in profits/losses and decision-making) is not required to carry coverage for those partners. A non-qualified partner must be covered.
LLC members
Same 'qualified member' framework as partners: an LLC composed entirely of qualified members (per KRS 342.012) is not required to carry coverage for those members; a non-qualified member must be covered.
Corporate officers
Corporate officers ARE employees by default under KRS 342.640(2), but may self-exclude by filing an Employee's Written Notice of Rejection (Form 4). No cap on the number of officers who may exclude was found in the sources reviewed.
How the exemption is filed
True state filing, but only in the rejection direction for officers/employees: Form 4 (Employee's Notice of Rejection of the Workers' Compensation Act) must be an ORIGINAL form obtained from the agency, bearing the employee's notarized signature — the agency will reject a photocopy, fax, or non-original form. It is filed with the Kentucky Department of Workers' Claims, Compliance Branch. Filing forfeits the filer's right to WC benefits. No fee was found in the sources reviewed. Sole proprietors/qualified partners/qualified LLC members are excluded by default and do not need to file anything to be excluded (they would instead file to elect INTO coverage under KRS 342.012, form/process not verified here).
