When coverage is required in Illinois

Illinois Workers' Compensation Act (820 ILCS 305) requires coverage once an employer has even one employee, including a part-time employee — confirmed via the official Illinois Workers' Compensation Commission (IWCC) insurance-information page. Coverage begins immediately upon hire; there is no waiting period.

Who can be excluded in Illinois

Sole proprietors

Not automatically covered — every sole proprietor may elect TO BE covered under the Act (820 ILCS 305/3(20)); absent that election, the sole proprietor is excluded from the Act's coverage as to themselves. (Sole proprietors' employees, if any, are covered regardless.)

Partners

Same regime as sole proprietors: every partner of a business may elect to be covered by the Act (820 ILCS 305/3(20)); absent election, excluded.

LLC members

Members of an LLC are treated the same as sole proprietors/partners under 820 ILCS 305/3(20) — may elect to be covered; otherwise excluded from coverage as to themselves.

Corporate officers

Treated in reverse from the sole-proprietor/partner/LLC-member rule: corporate officers of a domestic or foreign corporation who are employed by the corporation ARE automatically included in coverage by default, but may elect to withdraw themselves as individuals from the Act (820 ILCS 305/3(17)(b)) via written notice to the insurance carrier. A corporate officer who later wants to resume coverage must give the carrier written notice of that election, effective on the carrier's receipt. No numeric cap on the number of officers who may withdraw was found in the statute text reviewed. The IWCC's own insurance page states no specific form or fee is mandated by the Commission for this election — direct written notice to the carrier suffices; some private/insurance-industry sources reference an 'Election/Rejection of Coverage' form, but that is not shown to be an IWCC-mandated form.

Construction rules in Illinois

Construction and other 'extra-hazardous' occupations are enumerated in 820 ILCS 305/3(1) and are automatically brought within the Act — there is no election-out mechanism for the hazardous-occupation classification itself. Practically, this means the sole-proprietor/partner/LLC-member opt-out under 305/3(20) and the corporate-officer withdrawal under 305/3(17)(b) do not let a person avoid coverage while performing construction/hazardous work covered elsewhere in the same section — but I did not find an explicit statutory statement that 3(1) overrides 3(17)(b)/3(20) for the same individual; this interaction should be confirmed with counsel before being stated as settled law on a client-facing page.

How the exemption is filed

No state-run exemption certificate or registry exists. Sole proprietors/partners/LLC members are excluded by default and elect IN via written notice to their insurance carrier if they want coverage. Corporate officers are covered by default and elect OUT via written notice to their insurance carrier. The IWCC does not administer or require a specific rejection/election form for either direction — this is a carrier-notification process, not a state filing.
