Alaska Workers’ Comp Exemption

We file workers’ compensation exemptions for Alaska sole proprietors, LLC members, and corporate officers. Send us your details and we’ll confirm whether you qualify and handle the filing.

When coverage is required in Alaska

Any employer with one or more employees in Alaska must carry workers' compensation insurance (or be an approved self-insurer) — there is no minimum employee-count threshold. A short list of specific occupations/relationships fall outside the statutory definition of covered "employee" (e.g., commercial fishers, independent contractors, contract entertainers, some taxicab drivers, part-time babysitters, some cleaning persons, harvest help, some realtors, most unpaid volunteers), but this is not a size-based small-employer exemption.

Who can be excluded in Alaska

Sole proprietors

Not covered by default; the sole proprietor may choose to be included in coverage (employees of the sole proprietorship must still be insured regardless).

Partners

Not covered by default; partners may choose to be included in coverage (employees must still be insured).

LLC members

Not covered by default; LLC members may choose to be included in coverage (employees must still be insured).

Corporate officers

Executive officers of FOR-PROFIT corporations ARE covered by default and must affirmatively obtain an Executive Officer Waiver (EOW) from the Alaska Workers' Compensation Board/Division to be excluded. Executive officers of NON-PROFIT corporations are NOT covered by default and may choose to be included instead. "Executive officer" means the president, vice-president, secretary, treasurer, or another corporate employee specifically designated as an executive officer in the corporation's articles/bylaws with close ties to the board. Some secondary (non-official) sources describe a 10%-ownership threshold added by a 2019 Division bulletin for LLC members and executive officers, but I could not locate and verify that bulletin's text directly, so that specific figure is flagged as unverified rather than stated as fact.

How the exemption is filed

For sole proprietors, partners, and LLC members there is no state exemption filing at all — they are simply outside the default statutory definition of covered "employee" and need do nothing unless they affirmatively want to be included. For-profit corporate executive officers must instead file a Petition for Executive Officer Waiver (Form 07-6131) with the Division of Workers' Compensation, which requires: an Affidavit of Corporate Officers (signed before a notary by each named officer), proof the corporation is active/in good standing with the Alaska Division of Corporations, officer names matching the state corporate-registry record, a copy of the first page of the articles of incorporation plus bylaw pages naming officer titles/duties, and a copy of corporate meeting minutes reflecting the officers' election/appointment. No fee amount was stated on the form or found in any source reviewed; duration/expiration terms were likewise not stated (the form supports "Original," "Amendment," and "Cancellation" petitions, implying the waiver stays in effect until affirmatively amended or cancelled).

Notes and open questions

The Form 07-6131 URL above is a third-party mirror (Justia/American LegalNet) of the state's own form — I was not able to locate this exact form directly hosted on labor.alaska.gov during this session, though the state's official 'Workers' Compensation and You' pamphlet (fetched directly from labor.alaska.gov) independently confirms the same waiver mechanism and describes it consistently. A secondary source referenced 'Bulletin No. 19-03' establishing a 10% ownership requirement for owner exemptions/EOWs; I attempted to fetch that bulletin but retrieved an unrelated bulletin (18-02) instead, so the 10% figure should be treated as unverified and confirmed with the Division directly before publishing.
